Advocate General as Career

An Advocate General is the primary law officer for the state government. His position is analogous to that of Attorney General of India, who is the legal officer of highest rank of the Government of India. The Office of the Advocate General is highly constitutional and illustrious. He is appointed by the Indian Governor as per Article 165. He performs all the state level works. He holds all the administrative and financial powers.

Advocate General is the head of the Office and there is a team of Law officers who assist him. This team involves Additional Advocates General, Assistant Advocates General, Sr. Deputy Advocates General, and Deputy Advocates General. He also has to supervise the offices of-

• Government Pleaders
• High Court Government Pleaders
• Additional State Public Prosecutors
• Additional Government Pleaders

They deal with litigation work, but under the direction and supervision of the Advocate General. The High Court matters are dealt by the Government Pleaders and Government Advocates. On the other hand, the criminal issues are handled by the State Public Prosecutors and Additional State Public Prosecutors.

Advocate General and his team of Law officers tackle the court cases of the High Court. The law officers act as counselors to the government and also assist formulating policies and their implementation. Their work also includes drafting and filing petitions, affidavits, counter-affidavits, appeals, and statements. The Advocate General has a significant role in constitutional, political, legislative, legal, statutory, and administrative functions of the State.

The Advocate General holds the right to speak and be a part of the proceedings of both houses of state legislatures. He could also be a member of the proceedings of any committee of the legislature, though he cannot vote. He is entitled for all the legislative privileges, which are enjoyed by the members of a legislature.

Chief duties of Advocate General

• He has to offer legal advice to the state government on every legal issue, and he has to carry out legal duties. These duties are sometimes assigned to him by the Governor on a regular basis.
• As per the Constitution, certain duties are conferred to him. Or under some other law which is in force during his tenure.
• He represents the State in civil and criminal cases which involves proceedings and appeals of the High Courts and Supreme Court and many other Courts.
• He cannot stand for any private party especially if the party is against the government.
• He can be present as audience in the court of state where he is appointed as the Advocate General
